Please read carefully this release of liability and assumption of risks.

ORGANIZER – PARTICIPANT CONTRACT

This Release is entered on the date set out below in connection with ____________________ (Participant’s) application to tour with Danu Enterprises (“the Tour”).

Danu Enterprises and its agents and associates (referred to as Danu Enterprises) act only in the capacity of agent for all matters relating to transportation and all other related travel services utilized in connection with the Tour, and assumes no responsibility howsoever caused for injury, loss or damage, to person or property in connection with any such service, including but not limited to that resulting directly from: acts of God, detention, annoyance, delays and expenses arising from quarantine, medical emergencies and evacuation, strikes, thefts, pilferage, force majeure, failure of any means of conveyance to arrive or depart as scheduled, civil disturbances, government restrictions or regulation, discrepancies or change in transit over which it has no control. Reasonable change in itinerary may be made where deemed advisable for the comfort and well-being of the participants. And the Danu Enterprises will provide equivalent experiences in all such cases. On payment of the deposit, the Participant agrees to be bound by the terms and conditions of this Release. Prices are subject to change without notice, due to currency fluctuations or other causes.

AIR TRANSPORTATION: If, for any reason beyond the control of Danu Enterprises, scheduled flights or air fares are changed, any increase in air fare will be collected from the Participant, and any decrease in fare will be refunded. Participant will not attempt to hold the concerned airlines responsible for any act, omission or event during the time the Participant is not on board the aircraft and / or conveyances.The airline tickets issued by the airlines concerned, shall constitute the sole contract between these airlines and the Participant . The airline ticket is included in some of the Tour cost.

CANCELLATION FEES AND PENALTIES: are defined in the pre-tour information. No partial refund or credits will be given for unused services. Danu Enterprises reserves the right to accept, retain, or cancel any prospective or actual member of the Tour at any time, at any place, and for any reason, at our discretion. If Participant is removed from the tour, a proportionate refund will be made. Danu Enterprises will not reimburse Participant for any substitute arrangements not made by Danu Enterprises. Deviations from the pre-paid itinerary are at the Participants expense.

INSURANCE: WE STRONGLY RECOMMEND YOU PROTECT YOURSELF AND YOUR BAGGAGE WITH A SHORT TERM TRAVELERS INSURANCE POLICY. BAGGAGE IS CARRIED ENTIRELY AT PARTICIPANT’S RISK; DANU ENTERPRISES ASSUMES NO LIABILITY WHATSOEVER FOR DAMAGE, LOSS OR DELAY OF PROPERTY. TRIP CANCELLATION INSURANCE WILL COVER YOUR LOSSES ON NON REFUNDABLE AIR AND LAND COSTS OR TRIPS CANCELLED DUE TO ILLNESS.

PAYMENTS: The cost of the Tour is based on a minimum number of participants. If the minimum number is not met, Danu Enterprise reserves the right to cancel the Tour or increase the cost to participate in the tour.

RELEASE AND ASSUMPTION OF RISK: I am aware that during the Tour that I am participating in under the arrangements of Danu Enterprises and its agents or associates, certain risks and dangers may occur, including, but not limited to the hazards of hiking through mountainous terrain, sailing on open waters, accident or illness in remote places without medical facilities, forces of nature and travel by air, automobile or other conveyances. I consent to and agree not to hold Danu Enterprises responsible should any of its suppliers fail to provide the travel services I have purchased. In consideration of, and as part payment for, the right to participate in the Tour and other activities and the services and food arranged for me by Danu Enterprises and their agents or associates, I have and do hereby assume all of the above risks and will hold them harmless from any and all liability, action, causes of action, debts, claims, and demands of every kind and nature whatsoever, which I now have or which may arise in connection with the Tour or participation in any kind of activities arranged for me by Danu Enterprises and its agents or associates. The terms hereof shall be binding on my heirs, executors, assigns and administrators and all members of my family, including minors accompanying me. I have read and agree to these terms and conditions, especially noting the policy on cancellations and refunds on this sheet. I am aware that should I choose not to purchase insurance coverage as suggested under "Insurance:" above, I will be liable for all costs in the case of cancellation, delays, damage to or loss of baggage and medical emergencies of any kind whatsoever. Any controversy or claim arising out of or relating to this Agreement, or the making, performance or interpretation thereof, shall be settled by binding arbitration in Santa Cruz California, in accordance with the rules of the American Arbitration Association then existing, and judgment on the arbitration award may be entered in any court having jurisdiction over the subject matter of the controversy.
